    These Terms of Service explain the rules for using Wills & Power (willsandpower.com). By using our website or services, you agree to these terms. Please read them carefully — we have written them in plain English to make them easy to follow.

    Important: Wills & Power is not a law firm and does not provide legal advice. Our will-writing service is delivered via a third-party software platform, and our LPA service helps you complete official government forms. Neither service replaces independent legal advice. Please read Sections 5 and 6 carefully.

    1. Who we are

    Wills & Power is an online estate planning service for people in England and Wales. We offer two main services: an online will-writing tool powered by a third-party software platform, and guidance to help you complete Lasting Power of Attorney (LPA) forms.     2. Who can use our service

    You can use our services if you:

    • Are aged 18 or over

    • Are resident in England or Wales

    • Have the mental capacity to make the decisions involved (for wills and LPAs, this means you understand what you own, who you want to benefit, and the effect of the documents you are creating)

    • Agree to these Terms of Service

    3a. Online Will Writing (powered by a third-party software platform)

    Our will-writing service is provided through an affiliate partnership with an established third-party estate planning software platform. When you use this service:

    • You will be guided through a questionnaire to build a will tailored to your answers

    • The will document is generated by our software partner's platform on our behalf

    • Our software partner's own terms and privacy policy also apply to the processing of your data through their platform

    • You can download your completed will as a PDF

    Our software partner is a technology provider, not a law firm. Your will is generated based on the information you provide, and is not reviewed by a solicitor unless you purchase a separate legal review service.

    3b. Lasting Power of Attorney (LPA) Assistance

    A Lasting Power of Attorney is a legal document that lets you appoint someone you trust (an 'attorney') to make decisions on your behalf if you lose mental capacity. There are two types:

    • Property & Financial Affairs LPA — covers decisions about your money, property, and finances

    • Health & Welfare LPA — covers decisions about your care, medical treatment, and daily life

    Our LPA service helps you understand the process and complete the official government LPA forms (available at gov.uk). We provide:

    • Guidance on what each section of the form means

    • Step-by-step assistance to help you fill in the forms correctly

    • Information on how to register your LPA with the Office of the Public Guardian (OPG)

    We do not submit forms on your behalf. It is your responsibility to sign, have witnessed, and register your LPA with the OPG. An LPA is not legally valid until it has been registered.

    LPAs can be complex. If your situation involves significant assets, family disputes, or concerns about future capacity, we strongly recommend speaking with a qualified solicitor before proceeding.

    4. Creating your account

    To use our platform, you will need to create an account. You agree to:

    • Provide accurate and up-to-date personal information

    • Keep your password secure and not share your account with anyone

    • Let us know immediately if you think someone has accessed your account without your permission

    You can request deletion of your account at any time by contacting us at [email protected].

    5. We are not a law firm — no legal advice

    This is an important limitation. Please read carefully.

    Wills & Power is a document assistance service, not a law firm. This means:

    • We do not provide legal advice

    • We are not regulated by the Solicitors Regulation Authority (SRA)

    • Our will-writing service helps you build a document based on your answers — but we cannot assess whether it fully reflects your wishes or is suitable for your circumstances

    • Our LPA service helps you complete official government forms — but we cannot advise on whether an LPA is right for you, who you should appoint, or what powers to grant

    Nothing on our website or in our service should be taken as legal advice. If your circumstances are complex — for example, if you own property abroad, have a business, have been married more than once, or have dependants with special needs — please seek independent legal advice from a qualified solicitor.

    6. Third-party software partner

    Our will-writing service is delivered via an affiliate relationship with a third-party software provider. By using this part of our service, you also agree to be bound by our software partner's Terms and Conditions and Privacy Policy (available on their website).

    Wills & Power is not responsible for the availability, accuracy, or content of our software partner's platform. If you experience technical issues with the will-writing tool, we will do our best to help, but some issues may need to be resolved by our software partner directly. We may earn a fee when you purchase a will through our platform. This does not affect the price you pay.

    7. Your responsibilities

    When using our services, you agree to:

    • Provide honest and accurate information

    • Not use our service for any unlawful purpose

    • Not attempt to gain unauthorised access to our platform or systems

    • Not copy, reproduce, or resell any part of our service without our written permission

    If we believe you are misusing our service, we reserve the right to suspend or close your account.

    8. Signing and registering your documents

    Wills

    To be legally valid under the laws of England and Wales, your will must be:

    • Signed by you in the presence of two independent witnesses

    • Signed by both witnesses in your presence, at the same time

    Witnesses should not be beneficiaries of the will, or married to / in a civil partnership with a beneficiary. We provide clear guidance on this process, but it is your responsibility to ensure it is followed correctly.

    Lasting Powers of Attorney

    To be legally valid, an LPA must be:

    • Signed by you, your certificate provider, and your attorneys in the correct order

    • Registered with the Office of the Public Guardian (OPG) before it can be used

    An LPA takes effect only once it has been registered. We provide guidance on the registration process, but we do not register LPAs on your behalf.

    Keep signed copies of your will and LPAs in a safe place, and make sure your executors and attorneys know where to find them.

    9. Payments and refunds

    If you purchase a paid service:

    • Payment is taken at the point of purchase

    • All prices are shown in pounds sterling (£) and include VAT where applicable

    • You have the right to cancel and receive a full refund within 14 days of purchase, unless you have already downloaded your completed document

    • If you download your document within the 14-day cancellation period, you agree that the service has been fully delivered and your right to a cooling-off refund is waived

    To request a refund, contact us at [email protected] within the relevant timeframe.

    10. Your data and privacy

    We take your privacy seriously. The personal information you share with us — including details about your family, assets, health, and wishes — is used solely to provide our services. Some data related to your will may also be processed by our software partner as part of delivering the will-writing service. Please refer to both our Privacy Policy and our software partner's Privacy Policy for full details. We will never sell your personal data. Our services are subject to UK GDPR and the Data Protection Act 2018.

    11. Our liability

    We take care to ensure our platform works correctly and that the guidance we provide is accurate. However:

    • We are not liable for errors caused by inaccurate or incomplete information you provide

    • We are not liable for a will or LPA being invalid because it was not correctly signed, witnessed, or registered

    • We are not liable for any loss arising from failure to take independent legal advice where your circumstances required it

    • We are not liable for issues arising from our software partner's platform that are outside our reasonable control

    • Our total liability to you will not exceed the amount you paid us in the 12 months before the issue arose

    Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

    12. Changes to these terms

    We may update these terms from time to time. If we make significant changes, we will let you know by email or by displaying a notice on our website. Continuing to use our service after changes take effect means you accept the updated terms. The date at the top of this document shows when these terms were last updated.

    13. Closing your account

    You can stop using our service and close your account at any time. We may also suspend or close accounts that breach these terms, though we will notify you beforehand unless the breach is serious. Please download any documents you wish to keep before closing your account, as we may not be able to recover them afterwards.

    14. Governing law

    These terms are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
